Abstract
Pasal 66 UU No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UU 32/2009) menjamin perlindungan bagi pembela hak asasi manusia (HAM) atas lingkungan dalam menjalankan partisipasi publik pada pengelolaan lingkungan hidup. Pasal tersebut melindungi pembela HAM Lingkungan baik dalam gugatan perdata maupun tuntutan pidana yang dikenal dengan Strategic Litigation Against Public Participation (SLAPP). Namun faktanya, kasus-kasus SLAPP masih terus meningkat di Indonesia. Perempuan pembela HAM atas lingkungan (PPHAM Lingkungan) mengalami kerentanan berlapis dan tidak mendapat perlindungan dari pasal tersebut ketika terjadi SLAPP. Tulisan ini menganalisis Pasal 66 UU 32/2009 dengan menggunakan pendekatan Feminist Legal Theory (Teori Hukum Feminis) untuk menyelisik implementasi mekanisme Anti-SLAPP bagi PPHAM Lingkungan di Indonesia. Tulisan ini menemukan permasalahan substantif mulai dari tidak berlakunya perlindungan yang dijaminkan oleh Pasal 66 UU 32/2009 bagi PPHAM Lingkungan serta; lemahnya pemahaman aparat penegak hukum yang menjadi aktor pemidanaan PPHAM Lingkungan; hingga kuatnya budaya patriarki di Indonesia berkontribusi meningkatkan kerentanan berlapis PPHAM Lingkungan dalam berpartisipasi mengelola lingkungan hidup.
