Abstract
Setelah minyak gas dan bumi (migas) habis dieksploitasi, maka operator seharusnya memulihkan sumur minyak bekas produksi melalui kegiatan pasca operasi migas (Abandon Site Restoration/ASR). Namun, beberapa operator menolak bertanggung jawab dengan menyangkal kewajiban menyetorkan dana ASR untuk Blok Migas Terminasi. Alih-alih menegakkan hukum, Kementerian Energi dan Sumber Daya Mineral (ESDM) menerbitkan Peraturan Menteri ESDM Nomor 15 Tahun 2018 tentang Kegiatan Pasca Operasi pada Kegiatan Usaha Hulu Migas, yang secara implisit “mengamini” pengingkaran tanggung jawab ASR. Artikel ini mengkaji secara normatif ambiguitas pengaturan tanggung jawab ASR Blok Migas Terminasi di Indonesia, sebagai implikasi terbitnya Permen ESDM Nomor 15 Tahun 2018. Hasil penelitian menunjukkan bahwa beban kewajiban ASR di Blok Migas terminasi berpotensi dialihkan dari “kontraktor sebelumnya” kepada “kontraktor baru”, melalui ketentuan peralihan dana yang mencakup keseluruhan aset. Peristiwa tersebut menyimpangi asas pencemar membayar, sehingga Permen ESDM Nomor 15 Tahun 2018 tidak selaras dengan ketentuan “legislasi hijau”.
