Abstract
Dengan kekuatan modal yang besar, pengaruh International Financial Institutions (IFIs) dalam setiap proyek pembangunan di banyak negara berkembang tidak dapat dianggap remeh. Meskipun memiliki modal dan pengaruh yang besar, beberapa IFIs seperti World Bank Group kerap dituding sebagai pihak yang sulit untuk dimintai pertanggungjawaban atau minim akuntabilitas, khususnya dalam hal pertanggungjawaban terhadap masyarakat yang mengalami dampak negatif karena terdampak oleh suatu proyek yang didanainya. Fakta bahwa beberapa IFIs besar seperti World Bank Group berkantor pusat di Amerika Serikat menjadi alasan artikel ini mengeksplorasi isu pertanggungjawaban IFIs dari kasus JAM yang belum lama ini mendapat banyak sorotan dari berbagai pihak internasional. Artikel ini membahas aspek-aspek pertanggungjawaban IFIs dengan melakukan tinjauan hukum terhadap putusan kasus JAM terkait pencemaran lingkungan proyek pembangunan pembangkit listrik batu bara di Gujarat, India, yang didanai oleh International Finance Corporation sebagai sebuah studi kasus dan mekanisme penyelesaian sengketa di luar pengadilan.
