Abstract
Pencemaran udara merupakan masuk atau dimasukkannya zat, energi dan/atau komponen lainnya ke dalam udara ambien oleh kegiatan manusia sehingga melampaui baku mutu udara ambien. Pencemaran udara di wilayah DKI Jakarta membawa sekelompok masyarakat melakukan partisipasi publik melalui gugatan warga negara (citizen law suit) atas dasar perbuatan melawan hukum yang dilakukan oleh pemerintah, salah satunya terkait hak atas akses informasi terhadap inventarisasi emisi/udara. Tulisan ini menggunakan analisis normatif dan yuridis bertujuan mengetahui pemenuhan partisipasi publik dalam pemenuhan hak atas akses informasi lingkungan hidup dan implikasinya dalam Putusan No. 374/Pdt.G/LH/2019/PN.Jkt.Pst. Hasil analisis tulisan ini menunjukkan bahwa Gubernur DKI Jakarta berdasarkan Putusan No. 374/Pdt.G/LH/2019/PN.Jkt.Pst., terbukti lalai dalam memberikan informasi terkait hasil inventarisasi emisi daerah, sedangkan masyarakat telah melakukan partisipasi publik melalui gugatan warga negara dan menuntut pemenuhan hak atas akses informasi terkait inventarisasi udara.
